A BJP leader challenges the Supreme Court's decision to not order a CBI investigation after the Vijay rally stampede.

 


The appeal filed by Bharatiya Janata Party (BJP) leader Uma Anandan was mentioned before Chief Justice of India BR Gavai who agreed to list the case on October 10.

An appeal against a Madras High Court ruling that denied a Central Bureau of Investigation (CBI) investigation brought the Karur stampede dispute in Tamil Nadu all the way to the Supreme Court on Tuesday. 

Uma Anandan, a leader of the Bharatiya Janata Party (BJP), filed an appeal, and Chief Justice of India BR Gavai consented to list the case on Friday, October 10. 

Actor and party founder Vijay was campaigning at a gathering hosted by the Tamilaga Vettri Kazhagam (TVK) party in Veluswamypuram on September 27 when the stampede occurred. 

Reports indicate that the rally was only allowed to have 10,000 attendees, but estimates of the number of attendees range from 25,000 to 60,000. 

Many came early and waited for hours in hot weather with no facilities or enough water. Narrow roads, power outages, poor crowd control, and escape routes blocked by hoardings, ropes, and barricades all made the situation worse. 

Numerous people were hurt in the rush, and at least 41 people—including women and children—died. 

An FIR was filed after the event against a number of TVK employees, with the exception of Vijay, on allegations of culpable homicide not amounting to murder, failing to maintain safety, and misrepresenting the anticipated number of attendees and venue setup. 

On October 3, the Madras High Court's Madurai Bench declined to mandate a CBI investigation into the incident. 

The petitioners seeking a CBI investigation were not the victims of the stampede, according to a bench of Justices M Dhandapani and M Jothiraman, who also pointed out that the Tamil Nadu Police's investigation into the incident is still in its early stages. 
 


"We will provide assistance if anyone who feel wronged appear in this court. Who are you? This court should not be viewed as a political arena. You come if something goes wrong during the investigation. The High Court said, "This is the first step."

 The State government's submission that it will not allow any rallies or meetings close to state or federal highways until Standard Operating Procedures (SOPs) are formulated in that regard was recorded. 

While considering more than a dozen petitions submitted in the wake of the Karur stampede, the High Court issued the order. 

The current appeal before the highest court was brought about by this. 

It's interesting to note that the Madras High Court's major bench established a special inquiry team to look into the occurrence in a separate judgment.
