A doctor who was detained for posting recordings ridiculing Prime Minister Modi has been granted bail by the Punjab and Haryana High Court.

The prosecution claims that the accused's uploaded movies showed the Indian army and politicians "in a subdued state," while the Pakistani officials were depicted in a winning position.

A 65-year-old doctor who was detained by Haryana Police on May 17 for allegedly uploading altered footage of Prime Minister Narendra Modi and Home Minister Amit Shah has been granted bail by the Punjab and Haryana High Court [Mushtaq Ahmed v State of Haryana]. 

After noting the accused Mushtaq Ahmed's length of detention, Justice NS Shekhawat granted him regular bail. 

"The prosecution has not yet shown any evidence linking the petitioner to the crime. At this point, the investigation is nearly finished and there is nothing left to retrieve from the petitioner. Despite everything else, the petitioner is elderly and deserving of sympathy. Therefore, there will be no benefit to the petitioner's continued custody," the court declared. 

The prosecution claims that Ahmed's uploaded movies showed the Indian troops and politicians "in a subdued state," while the Pakistani leaders were depicted in a winning position. 

Following the Pahalgam terror assault, when tensions between India and Pakistan were at their highest, the videos were circulated. According to the police, such recordings would promote separatist sentiments and undoubtedly jeopardize the country's integrity, unity, and sovereignty. 

The accused's attorney, however, informed the High Court that he had merely sent the video and that there was no proof linking him to the alleged crime. Additionally, it was stated that he is an elderly person with a number of age-related health problems. 

The defendants were represented by Senior Advocate Bipin Ghai, along with attorneys Nikhil Ghai and Paras Talwar. 

The State of Haryana was represented by Additional Advocate General Rupinder Singh Jhand.
