Delhi, An advocate has asked Attorney General R Venkataramani's permission to file a criminal contempt case against attorney Rakesh Kishore for trying to hurl a sneaker at Chief Justice of India B R Gavai on Monday inside the courtroom.
AG's nod was intended to start a contempt case. For attempting to throw a shoe at CJI, Rakesh Kishore
"Sanatan ka apman nahi sahenge" was said by Kishore as he attempted to throw a shoe at the CJI in a startling security breach.
Kumar's bar license was immediately suspended by the Bar Council of India.
Advocate Subhash Chandran K R requested the attorney general's approval under Section 15 of the Contempt of Courts Act, 1971, in a letter.
According to the clause, if the Supreme Court or the high courts have firsthand knowledge of the contempt, they may start criminal contempt proceedings.
In the high courts, anyone can start an action with the advocate general's approval; however, if the same action is started in the top court, the attorney general and the solicitor general must agree.
According to the new plea, Kishore's actions of shouting slogans within the courtroom and trying to throw a shoe at the CJI's dais constituted a "deliberate attempt to undermine the dignity of the Supreme Court" as well as "gross interference with the administration of justice."
"The contemnor's most disdainful act undermines the Indian Constitution and diminishes the majesty and authority of the Hon'ble Supreme Court," it stated.
According to the letter, Kishore continued to disparage the chief justice in public appearances long after the incident occurred, demonstrating no remorse and instead defending his actions.
He maintained that such actions "show a clear intention to undermine public confidence in the judiciary and scandalize the court."
In a previous letter, the founder of Mission Ambedkar asked the attorney general for permission to file a criminal contempt case against YouTuber Ajeet Bharati and religious orator Aniruddhacharya, also known as Aniruddh Ram Tiwari, for allegedly instigating the attempted attack on the CJI.
