An interfaith couple goes missing after hearing, thus the Allahabad High Court will hold an extraordinary session on Saturday.
The petition alleges that the police did not give the two months of protection that the High Court had previously ordered to Rashmi and Shane Ali.
In order to consider a habeas corpus plea pertaining to an interfaith couple who allegedly vanished shortly after appearing before the Allahabad High Court earlier this week, the court has scheduled a special sitting for this Saturday.
The ruling, which was issued Friday by a Division Bench consisting of Justices Salil Kumar Rai and Divesh Chandra Samant, directed the State authorities to bring Shane Ali and Rashmi before the Court on October 18 at noon.
We conclude that the issue is extremely urgent based on the claims stated in the writ petition. The decision issued today states that the respondent nos. 2, 3, 4, 5, and 6 must produce the corpus, which includes the petitioner no. 2 and respondent no. 6's daughter Rashmi, tomorrow, October 18, 2025, at 12 p.m.
Additionally, the Bench stated that it understood the unique circumstances of the sitting, observing,
We are aware that tomorrow is a day off from work. Nonetheless, the office will make the required preparations for the court's sitting, and the respondents will present the corpus in this court, i.e., Court No. 43.
Advocate Ali Bin Saif, with assistance from Advocate Kaif Hasan, issued the directive in a habeas corpus plea submitted by Tehseem and another. According to the petition, on October 15, Shane Ali and Rashmi, two adults, left the High Court grounds where they had appeared in related criminal writ cases pertaining to their relationship, and they vanished.
According to the plea, the pair had previously petitioned the High Court for protection, claiming that Rashmi's relatives had threatened them and were against their relationship. Rashmi had testified before the Bench during the October 15 proceedings that she was living with Shane Ali voluntarily and that she wanted to wed him.
According to the petition, the two departed the court grounds after the hearing was over and have not been seen since. Around 5:00 p.m. on the same day, Shane Ali allegedly called his brother to inform him that Rashmi's father and other guys were pursuing him and Rashmi in an e-rickshaw close to PVR Subhash Chauraha in Prayagraj. Soon after, his phone rang, and he and Rashmi have not been seen since.
The plea also states that the same evening, the occurrence was brought to the attention of the court. In order to prevent the couple from leaving the city, the government advocate was requested to notify the Station House Officer of the Civil Lines Police Station in Prayagraj. However, the petition claims that even after the petitioner's family visited the police station later that evening, no First Information Report (FIR) was filed and no action was taken.
An earlier FIR filed on September 27, 2025, at Police Station Akrabad in District Aligarh, under Sections 87, 352, and 351(2) of the Bharatiya Nyaya Sanhita (BNS), is the basis for the habeas corpus plea. Rashmi's father, Naresh Kumar, filed the FIR, alleging that Shane Ali and his family had "lured away" his 20-year-old daughter.
The appeal claims that Rashmi's father submitted the FIR because he disapproved of her relationship with Shane Ali, calling it "false, fabricated, and filed with mala fide intent." The plea further points out that there was no justification for the two-month lag between the date of the claimed occurrence and the filing of the FIR.
It further emphasizes that Rashmi and Shane Ali were given two months of protection by the High Court earlier this year. In spite of this, the petition claims that the police "continued to harass Shane Ali's family members and failed to provide protection."
The petition also mentions Shane Ali's brother's alleged illegal imprisonment in September, which was finally lifted following the High Court's approval of a separate habeas corpus petition on September 9, 2025.
According to the plea, Shane Ali and Rashmi are both "major, consenting adults" who voluntarily live together. According to Rashmi's affidavit submitted to the court, she moved in with Shane Ali after leaving her house freely.
