Chief Justice BR Gavai has said that the Supreme Court should never revolve around the Chief Justice.


During a felicitation event hosted by the SCBA, the CJI emphasized the importance of a democratic process and the need for the Supreme Court to remain decentralized.

At a felicitation ceremony hosted by the Supreme Court Bar Association (SCBA), Chief Justice Gavai emphasized the need of a democratic system within the Court, stating that he is just one among many equals.

The Supreme Court, in my view, should never revolve on the Chief Justice; he or she is merely a peer among equals. Justice Gavai stated, "I believe in democratic functioning" since the court must include of all justices and members.

While addressing the concerns voiced by the Bar, he informed the audience that he had previously assigned specific tasks to two of his colleagues and that the other judges shared his opinion.

My colleagues Justice Narasimha and Justice Chandurkar have already been entrusted with the task. According to him, yesterday the members of the Bar Association were already granted an audience.

The Chief Justice also told the Bar that their demands would be reviewed constructively, but refraining from making any firm guarantees.

“I will not promise you anything but I can only assure that we will look at all the demands in a positive manner and we will always consider that the Bar is an equal stakeholder...We (the bar and the bench) are like two wheels of the golden chariot of the institution of administration of justice,” he said.

He alluded to the long-pending matter of allotment of lawyers’ chambers, which he claimed was settled within a short time in consultation with Justices Surya Kant and JK Maheshwari.

“As one of us mentioned, myself and Justice Surya Kant and Justice Maheshwari we resolved the issue of the allotment of chambers which was pending for almost five years. It took only two to three sessions for us to come to a logical conclusion,” he said.

Recalling earlier decisions during his tenure at the Bombay High Court, the Chief Justice said he has always strived to involve the Bar in infrastructural and administrative problems.

Whenever I got an opportunity, from my period at the Bombay High Court and when I was a member of the building committee, one of the first decisions I had taken was that whenever new buildings are to be constructed, the President and the Secretary of the Bar Association would be part of the committee so that the needs of the members of the Bar and litigants are taken into considerati
He also spoke about his support for granting the Bar access to institutional facilities such as the auditorium.

He stated that auditoriums at the Aurangabad and Nagpur benches of the Bombay High Court were made available to the Bar free of charge and that the same treatment has been provided in the Supreme Court as well with the cooperation of one of the previous CJIs.

Senior Advocate Vikas Singh, SCBA President CJI Gavai further thanked his colleagues and the Bar for their cooperation and said the Court registered extraordinary disposal rate of cases during the half working days this year.

“I should thank my colleagues for being very cooperative. In the partial working days we have had the biggest number of disposals this year during the partial working days in the last so many years. I thank my colleagues, I thank all the members of the Bar,” he said.

SCBA President Vikas Singh also addressed at the ceremony.
