Delhi Riots: Court condemns Delhi Police for falsifying evidence and clears six defendants of arson near a mosque


The Court determined that the accused men's rights had been gravely violated as a result of the Investigation Officer's fabrication of evidence.

Six men were accused of arson at the Azizia Masjid during the 2020 North-East Delhi riots, however a Delhi court recently chastised the Delhi Police for bringing a fake case against them.

Extra Sessions  Judge Praveen Singh went on to declare all six of the defendants in the case not guilty.

"It is clear that a bogus case has been imposed on the accused just to construct a case, and PW10 HC Vikas, the case's sole eyewitness, is wholly untrustworthy of these accused individuals.  In its decision on August 25, the Court declared that all of the accused had the right to be exonerated of all charges.

Ishu Gupta, Prem Prakash, Raj Kumar, Manish Sharma, Rahul, and Amit are the accused individuals who were found not guilty.

They were alleged to have been among a group of people who lit a scooty, houses, and stores close to Azizia Masjid on fire.

However, the trial court concluded that the Delhi Police's Investigation Officer (IO) had falsified witnesses and evidence in order to wrap up the case.  According to the court, this led to a grave violation of the accused men's rights.

The court said, "I must observe that the IO has egregiously padded the evidence, which has resulted in serious infringement of the accused's rights. The accused have likely been charged sheeted only to demonstrate that this case is resolved."

The court observed that the supervising authorities, the Station House Officer and the Assistant Commissioner of Police, likewise automatically transmitted the charge sheet in spite of the obvious inconsistencies in the IO's report.

During the accused's arrest and the inquiry, the Delhi Police committed a number of inconsistencies and procedural errors, the court further stated.

"I don't understand why the accused's identification process was done through photographs rather than their judicial TIP when they were already in custody," the court stated.

It then cleared all of the defendants and forwarded the case to the Commissioner of Police for corrective action.

The order said, "Since such incidents cause people's trust in the legal system and the investigation process to be seriously undermined, I think it is appropriate that a copy of this judgment be sent to the honorable Commissioner of Police for his review, along with a request to take corrective action."
