"I share Bar's feelings": Delhi High Court Chief Justice DK Upadhyaya on Justices Tara Ganju and Arun Monga's transfers 


The Delhi High Court Bar Association has strongly opposed the decision to transfer the two justices.


Justice Devendra Kumar Upadhyaya, the chief justice of the Delhi High Court, stated on Monday that he agreed with the Bar's opinions regarding the transfers of Justices Tara Vitasta Ganju and Arun Monga. 

"I want to start by saying that I respect the opinions of the bar over the transfer of our colleagues from this court. The Chief Justice stated, "I would like to once more convey my warmest regards to my colleagues and to join the Bar in their sentiment conveyed through the President today." 

At the farewell event for Justices Monga and Ganju, which was hosted by the Delhi High Court Bar Association (DHCBA), Justice Upadhyaya gave a speech. Justice Ganju has been sent to the Karnataka High Court, while Justice Monga has been moved to Rajasthan. 

Notably, the Bar's members fiercely opposed the transfers, particularly those of Justice Ganju. In a letter to Chief Justice of India (CJI) BR Gavai, the DHCBA, DHCBA women attorneys, and a number of other Bar members expressed their disapproval of Justice Ganju's removal. 

The Bar was deeply distressed by the transfers, according to DHCBA President N Hariharan, who spoke at the farewell ceremony today. 

"The pain must be spoken even when we are not to the point of conflict. We believe that if we remain silent, we would be neglecting our responsibilities as members of the Bar. In light of this, we have convened here today and are saying goodbye to the two judges," Hariharan stated. 

When the Bar members met with CJI Gavai on these transfers, they were given the assurance that no further judges would be transferred outside of Delhi, according to DHCBA Vice-President Sachin Puri. 

Justice Monga stated in his speech that this was his second trip out of Delhi. 

"I'm leaving here for the second time. My elevation as a judge [of the Punjab and Haryana High Court] was the first one. I came here as one of your own, I'm leaving as one of your own, and I'll always do that wherever I go," he remarked. 

It is difficult to say goodbye to a place that has influenced her as a judge and a lawyer, according to Justice Ganju. 
 


"A judge must be receptive to all challenges and see the nuances of human experience in addition to the black and white of a case. The beauty of our line of work is that every situation and every time has taught me something new," she remarked.
