In the broader conspiracy case under the Unlawful Activities Prevention Act (UAPA) pertaining to the 2020 North East Delhi riots, Sharjeel Imam has petitioned the Supreme Court for bail. [State of NCT Delhi v. Sharjeel Imam]
He and eight other people—Umar Khalid, Mohd Saleem Khan, Shifa Ur Rehman, Athar Khan, Meeran Haider, Shadab Ahmed, Abdul Khalid Saifi, and Gulfisha Fatima—were granted bail by the Delhi High Court on September 2.
In his appeal to the Supreme Court, Imam contested the ruling of the High Court.
After conflicts over the then-proposed Citizenship Amendment Act (CAA), riots broke out in February 2020. According to the Delhi Police, hundreds were injured and 53 people were killed during the riots.
The current lawsuit concerns claims that the defendants had devised a more extensive plot to instigate several uprisings. A Special Cell of the Delhi Police filed the First Information Report (FIR) in this matter in accordance with certain sections of the UAPA and the Indian Penal Code (IPC).
Many bail petitions were filed before various courts as a result of the majority of the suspects being charged in multiple FIRs. The majority have been detained since 2020.
Imam was charged with sedition and UAPA in the majority of the FIRs that were filed against him in several states.
Last year, the Delhi High Court granted him bail in the matter involving comments he made at Aligarh Muslim University and Jamia Milia Islamia University. He was granted bail by the Allahabad High Court in 2021 and the Gauhati High Court in 2020 in the sedition proceedings filed in Guwahati and Aligarh, respectively. Additionally, he was charged with FIRs in Manipur and Arunachal Pradesh.
