Kerala High Court requests the State's answer to a request to revoke the bail of a lawyer in a rape case.

On May 17, a trial court granted pre-arrest release to Rahib KY, the accused, citing a consensual relationship as justification.

On Thursday, the Kerala High Court sent a notice to the State about a plea to revoke the anticipatory bail of a lawyer accused of rape based on a fraudulent marriage commitment made by a female advocate in Ernakulam. 

On Thursday, the complainant's plea was placed before Justice G Girish. On May 17, a trial court granted pre-arrest release to Rahib KY, the accused, citing a consensual relationship as justification. 

The plaintiff, a 39-year-old divorcee, claims that she was forced to have an abortion in February 2024 after being the victim of multiple "sexual assaults" under false pretenses of marriage since July 2023. Later on, she found out that the man was seeing someone else. 

She has also charged Rahib with taking her possessions, which include documents, gold, and the property deeds of a rental home. The complainant and the accused had shared a residence for a while. 

She requested that the trial court revoke the relief it had given him, claiming that it had overlooked the fact that he had never planned to wed her and had started the marriage registration process simply to coerce her into ending the pregnancy. 

The accused had contended before the trial court that the complainant had been unable to fulfill the promise of marriage because his age and marital status had not been disclosed. But according to the complainant, he knew exactly how old she was and whether she was married. 

She further contended that the trial court overlooked the fact that the accused had taken her belongings. 

The petitioner and the second respondent shared a residence in the house where the break-in and theft took place, the honorable court noted. The plea argued that the Hon'ble trial court's perspective is biased and that it overlooked the fact that the second respondent left the petitioner's company and abandoned her on March 26, 2025, before returning to steal and break into the property on April 9, 2025.
