On July 22, a Varanasi district and sessions court ordered a magistrate court to reconsider the application to register a first information report (FIR) against Gandhi for his comments.
Gandhi then appealed the sessions court ruling to the High Court.
After hearing the case today, High Court Justice Sameer Jain postponed rendering a decision.
While considering a revision appeal submitted by a man named Nageshwar Mishra, the sessions court issued a directive against Gandhi.
After considering the pertinent Supreme Court precedents, the concerned magistrate was instructed by the sessions court to reexamine the case and issue a new order.
Gandhi allegedly made an offensive remark while in the United States, asserting that there is a sense of uneasiness among Sikhs in India, according to the plea Mishra filed in 2024.
According to the plea, the comment was provocative and meant to encourage people to take action in support of Gandhi's political objectives.
The plea further argued that Gandhi disseminated similar "propaganda" at a rally held on December 14, 2019, at Ramlila Maidan in Delhi, which led to a large-scale demonstration at Shaheen Bagh in Delhi that tragically descended into chaos and violence.
Under the proviso to Section 208 of the Bharatiya Nyaya Sanhita (BNS), an offense committed outside of India cannot be investigated or tried in India without prior Central government approval, the Magistrate court noted when first dismissing the plea.
As a result, the sessions court heard a revision plea and allowed the case to be reheard.
Gandhi then challenged the order in the High Court.
Senior Advocate Alok Ranjan Mishra represented Gandhi.
