Rahul Mamkootathil, a Congress MLA, petitions a Kerala court for anticipatory bail in a rape case.

 Mamkootathil argues that the complainant is married to another man and that the connection was consensual.
 

 

Rahul Mamkootathil, a member of the Legislative Assembly (MLA), went the Thiruvananthapuram Sessions Court on Friday to request anticipatory bail in a rape case that the Nemom Police had filed against him. 

After multiple women accused him of sexual misbehavior, the Congress party suspended his membership in August of this year. Mamkootathil also tendered his resignation as Chief of the Youth Congress. 

After the survivor woman and her family met with Chief Minister Pinarayi Vijayan at the Secretariat on November 27 and submitted a written complaint, the police filed the first information report (FIR) in the current rape case. 

Mamkootathil has been charged under several sections of the Bharatiya Nyaya Sanhita (BNS), which include rape, miscarriage, and criminal breach of trust. In accordance with the Information Technology Act, he has also been charged. 

The complainant claims that Mamkootathil compelled her to get an abortion after raping her and getting her pregnant. Additionally, she said that Mamkootathil filmed her private moments and then threatened to make them public. 

Mamkootathil has claimed in his petition that the accusations made against him are untrue, baseless, and driven by politics. He has asserted that no such complaints existed before to his ascent and that the allegation was only made after he become a prominent opposition MLA and youth leader. 

Although he acknowledges in the petition that he had a sexual contact with the plaintiff, he has maintained that it was voluntary. 

As per the plea, 

Since the relationship between the petitioner and the victim was voluntary, the claimed offense will not be covered by U/S. 64. This will be corroborated by the conversations and phone conversations between the parties. The victim acknowledges that she visited the petitioner in several locations because the relationship was consensual. 

Importantly, he has also claimed that the complainant lives with and is married to a member of the BJP. This, along with the fact that she was employed by a media outlet, demonstrated that the complaint was made for political reasons. 

Additionally, Mamkootathil has claimed that this was an attempt by the Left government to divert attention away from the continuing dispute over the theft of gold from the Sabarimala shrine. 
 


Mamkootathil has requested anticipatory bail from the Sessions Court on these grounds, claiming that his custodial interrogation is not required in this matter.
