Savarkar Defamation: Rahul Gandhi claims in a Pune court that he is in danger of dying, citing the complainant's Godse ancestry.

 


Since the complainant's family has a history of violent inclinations, it was argued that there is a legitimate fear that Shri Rahul Gandhi could be harmed.

In the defamation lawsuit against him, Rahul Gandhi, the Congress politician and leader of the opposition in the Lok Sabha, told a Pune court on Wednesday that his life is in danger because of his recent political conflicts and the ancestry of the complainant, Satyaki Savarkar.

In a defamation lawsuit, he called on the special MP/MLA court to take judicial note of what he has called "severe apprehensions" about his safety and the fairness of the case's processes.


"Preventive protection is not only prudent, but the State is required by the Constitution to provide it," it said.

Gandhi described the action as a "protective and precautionary measure for safeguarding the fairness, integrity, and transparency of the present proceedings" in the application submitted through counsel Milind Dattatraya Pawar.

The application also pointed out that Satyaki Savarkar had explicitly acknowledged in a written statement submitted on July 29 that he is descended from Vinayak Damodar Savarkar and is a direct descendant of Nathuram Godse and Gopal Godse, the main suspects in Mahatma Gandhi's murder.

It was argued that "there is a clear, reasonable, and substantial apprehension that Shri Rahul Gandhi may face harm, wrongful implication, or other forms of targeting... given the documented history of violent and anti-constitutional tendencies linked to the complainant’s lineage."

According to the plea, the assassination of Mahatma Gandhi was not an act of whimsy but rather the planned result of a conspiracy with a certain philosophy that led to intentional violence against an unarmed person.

It was argued that "the defense harbors a genuine and reasonable apprehension that history must not be permitted to repeat itself, given the grave history associated with such lineage."

The application also described Gandhi's recent political initiatives, which he said have incited animosity from political rivals, such as his use of the August 11 slogan "Vote Chor Sarkar" in parliament and the filing of paperwork claiming electoral violations.

Additionally, the petition cited his parliamentary statement in which he declared, "A true Hindu is never violent."  Hatred cannot be spread by a Hindu.  You do not speak for Hindus, and the BJP incites violence and hatred.

He emphasized how BJP MP Sudhanshu Trivedi and Union Minister Ashwini Vaishnaw immediately organized news conferences accusing him of demeaning the Hindu community and diminishing the honor of his post.

Additionally, it referenced two threats made in public by BJP leader Tarvinder Singh Marwah and Union Minister Ravneet Singh Bittu, who referred to Gandhi as the "number one terrorist of the country."

After Gandhi gave a lecture in London in March 2023, citing an episode in Savarkar's writings in which Savarkar and others allegedly abused a Muslim man and deemed it "pleasurable," Satyaki Savarkar initiated a defamation suit against Gandhi.

Satyaki Savarkar filed a court case arguing that the statements were false, deceptive, and defamatory, disputing the existence of such an account in Savarkar's published writings.

He has requested compensation under Section 357 CrPC and Gandhi's prosecution under Section 500 IPC.

The case will be heard by the Court again on September 10.
