The Supreme Court refuses to consider LoP Rahul Gandhi's objection against CIC appointments.
The Bench declared that it would not use the hearing as a means of evaluation.
On Tuesday, the Supreme Court declared that it would not review the Leader of the Opposition's (LoP) dissent or evaluate the relative merits of the applicants for the Central Information Commission (CIC).
A petition pertaining to the appointments and vacancies of the Chief Information Commissioner and Information Commissioners was being heard by the bench comprising Chief Justice of India Surya Kant, Justices Joymalya Bagchi, and NV Anjaria.
Advocate Prashant Bhushan noted during the hearing that although the names of the chosen applicants had been made public, information on the shortlisted applicants, their credentials, and the dissent noted by the LoP had not.
According to CJI Kant, the proceedings had a narrow scope.
"Filling the vacancies was the goal of the legal proceedings...Here, comparison cases are not possible. The Chief Justice remarked, "We cannot perceive that this individual is superior to the one nominated.
The Bench reaffirmed that it will not use the hearing as an evaluation tool when Bhushan persisted in raising the matter.
The Court declared, "We cannot hold that type of trial here."
The Chief Justice also emphasized the significance of the institution itself.
This is a centrist public institution. Remember, we don't want a refuge for retirees either. It ends if the public does not come forward.
Additional Solicitor General KM Nataraj, speaking on behalf of the Central government, told the Court that the positions of Chief Information Commissioner and Information Commissioners had been filled and that the names of the selected individuals were already publicly available. He argued that each issue could be handled independently.
In accordance with its previous rulings, the Bench ordered that a status report be submitted. While noting that its current focus was to guarantee that the commissions continue to function, it also took note of submissions on vacancies and pendency in various states.
Following the filing of the status report, the matter will be listed.
