Typos don't render Sunjay Kapur's will void: Priya Sachdev Kapur to Delhi High Court

Priya Kapur's attorney contended that nobody had questioned Sunjay Kapur's signature on the will as being real.
On Wednesday, Priya Sachdev Kapur testified before the Delhi High Court that her husband Sunjay Kapur's will is authentic and that the claims that she falsified it are untrue.
Senior Advocate Rajiv Nayar represented Kapur, stating that no one has contested the validity of Sunjay Kapur's signature on the will and that typographical flaws in the document do not render it void.
"A will can only be challenged if the deceased was not of sound mind, or if he was unable to carry out the terms of the will due to coercion." I've been informed that there are four more grounds, including misspellings, incorrect addresses, mistakes such as writing "testatrix" instead of "testator," and the proximity of witnesses. Are spelling mistakes grounds for invalidating a will? Nayar inquired.
He added that the will is still legitimate despite the fact that it was produced seven weeks after Sunjay Kapur's passing.
Is the mere fact that the will came to light seven weeks later grounds for invalidating it? Is that a legally maintainable challenge? Will the will be deemed void if I kept it in my pocket and it comes to light at the right moment?
Nayar Rajiv While Justice Jyoti Singh was considering the partition petition brought by actor Karisma Kapoor's two daughters, who wanted a portion of their father Sunjay Kapur's assets, Nayar Nayar made the arguments. In order to prevent Priya Kapur from establishing any third-party rights over the assets, Nayar was against the plea for temporary relief.
The siblings claim that Sanjay Kapur's third wife, stepmother Priya Kapur, forged Sunjay Kapur's will in an attempt to seize complete control of the estate.
Before divorcing, Karisma Kapoor and Sunjay Kapur were wed for 13 years, from 2003 to 2016. Together, they have a daughter and a boy. Later on, Sunjay wed Priya.
A will dated March 21, 2025, that purportedly bequeaths Sunjay Kapur's whole personal wealth to Priya Sachdeva Kapur is at the heart of the conflict.
Today, Nayar made the incorrect claim that Karisma Kapoor had attempted to fabricate a story about her relationship with Sunjay Kapur being perfect.
"The current wife will obviously be preferred over the estranged wife in a wife-versus-wife situation," he stated.
Regarding the authenticity of the two witnesses to the will, Nayar stated that they were the Company Secretary (CS) and Chartered Accountant (CA), and that a CS and CA employed by the company also signed Sunjay Kapur's father's will.
"I have also produced affidavits of the two witnesses," he continued.
On Friday, Nayar will continue his arguments.
In a previous appearance on behalf of the plaintiffs, Senior Advocate Mahesh Jethmalani said that Priya Sachdev Kapur had falsified the will with the assistance of the executor and two witnesses.
