When a youngster is caught driving, a Srinagar court deems the guardian guilty. 


However, the offender was placed on probation by the court.
 


After a youngster was seen using a car in contravention of the Motor Vehicles Act, a Srinagar court fined the guardian (accused) ₹25,000 and sentenced him to three years of simple jail. 

However, upon his guilty plea, the convicted guardian was freed under the Probation of Offenders Act by Special Mobile Magistrate (Traffic), Shabir Ahmad Malik. 

Additionally, the court mandated a 12-month termination of the vehicle's registration.In light of the aforementioned facts and circumstances as well as the accused's admission of guilt, the accused is found guilty of the crime under Section 199.I suggest that the offender be sentenced to three (3) years of simple imprisonment and a fine of Rs. 25,000. Additionally, the vehicle registered under the license plate JK04K-0673 will have its registration revoked for a year," the judge said. 

The accused was ordered to sign a bond of ₹2 lakh rupees to maintain good behavior and peace during the two-year probationary period. 

The Court underlined that if the accused violates any of the bond's requirements during the probationary period, the government will forfeit the bond payment of rupees ₹2 lakh and the accused will receive the suggested penalty. 

Court documents show that a challan was filed against the guardian, who was also the vehicle's registered owner, when the youngster was discovered operating the vehicle. 

Section 199A of the Motor Vehicle Act, which holds guardians or car owners accountable when minors use their vehicles to commit crimes, was cited by the prosecution. 

The accused willingly entered a guilty plea to the crime during the court procedures and decided not to challenge the verdict. 

Without holding a full trial, the court found the accused guilty after evaluating the voluntariness of the plea and the seriousness of the offense.
