On the grounds that it was sensitive, the Delhi Police had resisted giving the accused a copy.
In the Delhi Police case involving naked protests at the India AI Impact Summit, Uday Bhanu Chib, the leader of the Indian Youth Congress (IYC), was granted a copy of the first information report (FIR) by a Delhi court on Tuesday.
The police were instructed to provide Chib with a copy of the FIR by Judicial Magistrate First Class (JMFC) Ravi of the Patiala House Courts.
Notably, the Delhi Police had argued that it was sensitive and had refused to give the accused a copy.
The Court did state, however, that a police classification of a matter as sensitive is insufficient to prevent a copy of the FIR. Judge Ravi went on to say that the court must consider the gravity of the offenses.
He claimed that the case against Congress employees was the result of symbolic protests "lacking hallmarks of terrorism/insurgency" and that it would be against Articles 21 and 22 of the Indian Constitution to deny a copy of the official complaint.As a result, it is not considered sensitive; the Investigating Officer's [IO] assertion is unsupportable. Denying a copy of the FIR is against both the constitutional protections of Article 21 (fair procedure) and Article 22 (prompt information on arrest grounds) as well as the statutory duty under Section 230 BNSS. Without a foundational document, the applicant cannot prepare bail or a defense, which would cause irreversible harm. The Court determined that "supply poses no investigation risk, especially post-transfer to Crime Branch."
Today, Chib was placed under four days of remand with the Delhi Police.
On February 20, IYC members participated in a shirtless protest within the India AI Impact Summit, which was hosted at Bharat Mandapam.
Before protesting against Prime Minister Narendra Modi and government policies, a number of activists entered the site, some taking off their shirts to display T-shirts with slogans like "PM is compromised" and criticisms of the India-US trade deal.
Eight people have been arrested by police in this case so far, and they were charged with violating security and yelling "anti-national" chants at the location.
Through attorney Rishav Ranjan, Chib had submitted the plea.
Advocates Shubhash Gulati, Roopesh Singh Bhaudaria, Chitwan Godara, Sumit Rawat, Keshav Nagi, and Mohit Garg appeared on behalf of Chib, accompanied by Senior Advocate Sanjoy Ghose.
The Delhi Police were represented by Atul Shrivastava, Additional Public Prosecutor (APP).
