After being found guilty in a check bounce case, a felon and his attorney threw insults and threats at the female judge in an open courtroom, leaving the Delhi court in disbelief.
When the judge failed to issue an order in his favor, the accused even tried to throw an object at him. He then gave his attorney instructions to take any necessary steps to obtain a favorable ruling.
As stated in the Court's ruling dated April 2, the accused informed the court, "Tu hai kya cheez............ ki tu bahar mil dekhte hai kaise zinda ghar jaati hai........" (Who exactly are you? Just meet me outside and let's see how you make it back home alive).
The accused was found guilty of a crime under Section 138 (dishonor of check) of the Negotiable Instruments Act by Judicial Magistrate (NI Act) Shivangi Mangla, who further ordered that bail bonds be provided under Section 437A CrPC on the next hearing date.
However, Judge Mangla noted in her judgment that the accused and his attorney reportedly physically and psychologically assaulted the lady judge after the conviction, forcing her to leave her position.
They harassed her once more and demanded that she clear the accused.
They also threatened to have her resigned under duress and to file a complaint against her.
According to the judge, the National Commission for Women would take necessary action against the accused for the harassment and threats.
"The undersigned continues to defy all odds and always take necessary action in support of justice. The Court ordered the undersigned to take appropriate action against the accused for the harassment and threats in front of the National Commission Woman in Delhi.
Additionally, the judge sent a show-cause notice to the convict's attorney, Atul Kumar, asking him to explain why he shouldn't face criminal contempt charges for his mistreatment of her.
"Court notice be issued to counsel for accused Sh. Atul Kumar to show cause in writing providing relevant explanation for the conduct shown by him today and further to explain as to why he shall not be referred to the Hon’ble High Court for initiating criminal contempt proceedings against him for such misbehavior."
The attorney was instructed to provide the response on the following hearing date.
